These Terms of Use (“Terms”) govern your use of the services and products provided under the brand Forested (“we”, “us”, or “our”), based in Mumbai, Maharashtra, India. By purchasing an AI system, booking a consultation, joining a waitlist, or using our website, you agree to be bound by these Terms.

1. Overview

Forested provides pre-built AI implementation systems and consulting services to businesses globally. These Terms apply to all engagements, whether through our website, system purchases, waitlist registrations, or direct communication.

2. Service Description

We offer AI implementation solutions delivered through two primary channels:

  • AI Systems: Pre-built, ready-to-deploy AI implementation packages designed for specific business functions (e.g., lead generation, content creation, sales automation). Each system includes guided setup sessions conducted online.
  • Consulting Sessions: One-on-one strategic guidance and hands-on implementation support delivered via online sessions to help businesses integrate AI tools and workflows.

3. AI Systems & Products

Our AI systems are productised implementation packages. When you purchase a system:

  • You receive access to the specific system as described on its product page, including all listed features and included setup sessions.
  • System descriptions, features, pricing, and availability are subject to change. The terms applicable at the time of your purchase will govern your engagement.
  • Systems may require you to have accounts with third-party AI tools or platforms, which are your responsibility to obtain and maintain.
  • Some systems may be listed as “Coming Soon” and available for waitlist registration only.

4. Booking & Scheduling

Setup sessions included with AI systems, as well as standalone consultations, are booked through our scheduling system. By submitting a booking request, you provide information necessary for us to prepare for the session.

Sessions are conducted via Google Meet or similar video conferencing platforms. You are responsible for ensuring you have a stable internet connection and access to the meeting platform.

5. Pricing & Payment

Pricing for each AI system is displayed on its respective product page. Prices are quoted in US Dollars (USD) unless otherwise stated.

Payments are processed securely via our third-party payment processor. Applicable taxes, if any, are the responsibility of the client based on their jurisdiction. Promotional discounts, if offered, are applied at the time of purchase and cannot be combined or applied retroactively.

6. Refund Policy

All sales are final. For complete details on our refund policy, including rescheduling and session expiry, please refer to our Refund Policy page.

7. Session & Delivery Completion

All sessions included in a system purchase must be completed within 30 days from the date of purchase. Unused sessions after this period will expire and will not be refunded or extended unless agreed upon in writing.

8. Waitlist & Pre-Registration

Some AI systems may be available for waitlist registration before launch. By joining a waitlist:

  • You provide your name, email, designation, and company website for the purpose of receiving updates about the system’s availability.
  • Joining a waitlist does not constitute a purchase or guarantee availability, pricing, or features of the final product.
  • We may contact you via email when the system becomes available. You can opt out of communications at any time.

9. Confidentiality & Non-Disclosure

Both parties acknowledge that during the course of the engagement, they may receive or have access to confidential information belonging to the other party.

“Confidential Information” includes, but is not limited to: business processes, financial information, customer data, proprietary methodologies, AI implementation strategies, system configurations, trade secrets, and any other information designated as confidential or that a reasonable person would understand to be confidential.

Each party agrees to:

  • Keep all Confidential Information strictly confidential and not disclose it to any third party without prior written consent.
  • Use Confidential Information solely for the purpose of fulfilling obligations under this engagement.
  • Take reasonable measures to protect the confidentiality of such information, no less protective than those used to protect their own confidential information.

This confidentiality obligation survives the termination of the engagement and remains in effect for a period of two (2) years thereafter.

10. Client Responsibilities

  • You are responsible for the cost of and access to any third-party AI tools, software, or platforms required by the AI system you have purchased.
  • You agree to provide accurate and complete information necessary for the effective delivery of our services and system setup.
  • You are responsible for implementing, maintaining, and testing any AI solutions in your own environment after the setup sessions are complete.
  • You acknowledge that results from AI systems may vary based on your business context, data quality, and how the system is used.

11. Intellectual Property

Client work product: Any AI implementations, workflows, or configurations built specifically for the client during setup sessions are owned by the client upon full payment.

Our systems and methodologies: Forested retains all intellectual property rights in its AI systems, proprietary methodologies, frameworks, templates, and general knowledge. Purchasing a system grants you a non-exclusive, non-transferable license to use that system for your own business purposes. You may not resell, redistribute, or white-label our systems.

Third-party tools: Any third-party AI tools, software, or platforms used as part of our systems remain the property of their respective owners and are subject to their own terms of service.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Forested’s total liability for any claims arising out of or relating to these Terms or our services shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
  • Our AI systems and services are implementation tools. We do not guarantee specific business outcomes, revenue increases, or results from AI implementations.
  • We are not responsible for any decisions made or actions taken by the client based on our systems or recommendations.

13. Termination

Either party may terminate the engagement under the following conditions:

  • By the client: You may discontinue services at any time. No refunds will be issued for systems or sessions already purchased.
  • By Forested: We reserve the right to terminate the engagement if the client engages in abusive behaviour, violates these Terms, or fails to make timely payments.

Upon termination, the confidentiality obligations in Section 9 shall survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

15. Changes to These Terms

We reserve the right to update these Terms at any time. The “Last updated” date at the top of this page indicates when the Terms were last revised. Continued use of our services after changes constitutes acceptance of the updated Terms.
